What You Should Know If You're Going to Buy

If you've decided to become a property owner, you should know that the buying process isn't always easy, so having the knowledge at hand to better position you when selecting the right property and real estate professional will be of great importance.

WHERE SHOULD YOU BUY?

It will depend on whether you want to acquire a profitable property, focused on protecting your assets and how to grow them, or whether you want to acquire your primary residence, or whether you want to acquire a seasonal home and rent it out while you're not using it. In this case, you want a solution that works in any scenario. Depending on your decision, some areas will be more suitable than others, as will the type of property, the availability of additional services, etc.

THE OFFER

Once you've decided on a property, you'll need to make an offer. This is the way to communicate to the seller your interest in the property and the price you're willing to pay. The real estate agent is responsible for guiding you through the drafting of this document. It's a good idea to include the bank's approval letter for financing the transaction, if financing is desired.

ACCEPTANCE OF THE OFFER

If the seller accepts the offer, the Earnest Money Contract will be signed, in which the buyer will pay a percentage of the property's price, usually 10% of the offered price. This contract will outline the terms of the purchase, the deadlines, and the payments to be made, so that both buyer and seller are fully aware of the process and the obligations and rights they will acquire upon signing.

THE FIRM

Once the transaction has been documented and the purchase date specified in the Earnest Money Contract has arrived, it will be time to visit the Notary Public chosen by the buyer to sign the Public Deed.

At the signing ceremony, the buyer will make payment for the remaining amount and the title will be transferred to the new buyer.

PURCHASE EXPENSES

The purchase of the property entails additional costs beyond the price indicated on this website. These costs amount to approximately 101% of the property's price. Detailed information about the entire transaction will be provided to you at our office.

These expenses are:

Notary fees are regulated by the State, with a more or less fixed price for the services provided. These fees usually increase with the number of pages, copies, and other ancillary services. They typically range between €850 and €1,300.

The taxes to be paid will differ depending on whether the property being purchased is newly built or second-hand:

  • New property: IGIC of 7% plus AJD at 0.75% of the property price.
  • Second-hand property: Property transfer tax (ITP) at 6.5% on the highest of the following two values: reference value according to the Land Registry and purchase price.

The deed of sale must be registered in the Property Registry and involves a payment ranging from €300 to €500 depending on the price of the property.

The real estate agency or independent agency will provide the buyer with an estimate of the purchase costs. The buyer will receive a provision of funds based on this estimate. These procedures include collecting the deed from the notary, preparing and settling taxes, submitting it to the Property Registry for registration, and any other issues that may arise. Since these are independent professionals, the amount can vary significantly, so we recommend requesting estimates of these costs from several agencies or agencies.

This fee will only be required if you apply for financing. An appraiser provided by the bank will value the property so the financial institution can calculate the financing percentage it will grant. Typically, the appraisal value is 80%. This amount typically amounts to around €400.

ARE YOU NOT A TAX RESIDENT IN SPAIN?

If this is your case, you will have to complete some procedures prior to signing at the notary's office:

  1. Apply for a NIE (Tax Identification Number for foreigners), provided you intend to stay in Spain for more than three months a year and can prove the economic, professional, or social reasons that justify the application. If you plan to stay for less than three months a year, there is an extraordinary procedure that allows foreigners without a NIE to obtain a NIF with the initial letter M.
  2. Have a bank account that streamlines all your transactions in Spain and where you can direct debit your recurring payments, such as home insurance, municipal taxes and fees, etc.

  1. Non-resident income tax at 19% for residents of the EU, Norway and Iceland, and at 24% for the rest of the world
  • It taxes the mere ownership of property in Spanish territory. The tax base is 1.5% to 2% based on the Cadastral Value, established by the General Directorate of Cadastre. The rate will be the result of applying the corresponding rate (19% or 24%) to the tax base.
  • It taxes income earned through property in Spain. The rate is the result of applying the 19% rate to the difference between income and expenses for residents of the EU, Norway, and Iceland. For the rest of the world, the rate is obtained by applying the 24% rate to income.
  • Taxes capital gains from the sale of a property in Spain. The rate is calculated by applying the corresponding rate to the capital gain obtained. If the capital gain is negative, the Tax Agency will consider a refund of the 3% withholding tax on the sale.
  1. Property tax, or IBI, is collected by the City Council. It varies depending on the City Council and is applied based on a percentage of the property's cadastral value, as established by the State.
  2. Garbage Collection and Waste Treatment Fee, collected by the City Council. The annual fee is usually collected two or four times a year.
  3. Supplies of electricity, water, internet, television
  4. Insurance: home, health, vehicle
  5. Community fees, if your property belongs to a community of owners.
